Dear Friends,

For many years AUN and other associations have fought against uncontrolled and unsustainable urban development in the Valencian Community. During this period, we exchanged views with many of you on the status of planning in general, as we became aware that rampant urban development was not exclusive to our Community. Indeed, it has become rather wide spread and essentially covers the whole country like a mediaeval plague. Each autonomous region has adopted laws similar to the Valencian land laws that encourage speculation and outrageous planning, with its attendant corruption, rising house prices, environmental degradation, while burying us in asphalt and cement. “Urbanismo” has been seen as a rich source of instant wealth feeding the politicians’ and developers’ insatiable appetites.

All this is still happening around us, despite some considerable achievements in our campaign against urbanistic and environmental abuses. AUN brought these to the attention of the European Parliament and the European Commission, resulting in a series of devastating parliamentary reports (Fortou and Auken) against the Valencian and other regions’ town planning laws, while AUN’s complaint to the Commission was ruled admissible before the European Court in Luxembourg and is in process. A favourable decision, i.e. a decision against Spain, can affect all other regional planning laws in the points they have in common.

For these reasons and because we have seen that in many regions similar groups in Spain have organized to defend their rights to property ownership, the undersigned agreed to establish a Spanish Federation of Associations with the common interest of truly sustainable development, while defending our human rights, especially those relating to property ownership and fighting against urban and environmental abuses, in accordance with Spanish, EU and international law.

The purpose of this letter is therefore to advise you of the creation of a Spanish Federation of Associations in Defense of Human rights and against Urban and Environmental Abuses (Federación Española de Asociaciones en defensa de los Derechos Humanos y en contra de los Atropellos Urbanísticos y Medioambientales).  This new federation has been registered with the National Register of Associations under number 50856.

We invite you to join this newly formed Federation whose principal objectives are to:

· Raise the level of our demands to the national government in Madrid;

· Attract the attention of the Spanish national and international media;

· Take our concerns and complaints to the European Parliament and other European institutions;

· Get the National land law amended, particularly as regards the predominance of the Developers/Agentes Urbanizadores and the proper evaluation for adequate compensation for property in cases of expropriation;

· Write a “white” or policy paper on Urbanismo for the guidance of local, regional and national authorities;

We must seize the opportunity provided by the current economic and financial crisis that has restrained land grab and construction activity to ensure that demands are being met.

We believe that with more associations as members and wider geographic spread, the greater our strength and effectiveness will be.

To make it easier for you to decide if you wish to join the Federation, we enclose a copy of the Statutes (Spanish only) and a pro forma record of the membership agreement (Acta Federacion) that you would have to subscribe to. The Statutes are those required by Spanish law and are particular in sections such as Goals and Objectives and the membership of the provisional Executive Committee.

The decision to join us can be taken by the Executive Committee (Junta directiva) of affiliating associations or by vote in their own plenary assemblies, depending on each association's statutes.

In accordance with said Statutes, we plan to convene the first General Assembly on October 24 (subject to confirmation) in Madrid. This meeting will serve as a starting point for the activity of the Federation.

In closing, we ask for your support and hope that your Association will be part of this new Federation and help take our common concerns forward. We hope that you understand and agree with the motives underlying our new Federation and that you and your Association will join us in becoming a more potent force to be heard on the national stage.

FEDERACION ESPAÑOLA DE ASOCIACIONES EN DEFENSA DE LOS DERECHOS HUMANOS Y EN CONTRA DE LOS ATROPELLOS URBANISTICOS Y MEIOAMBIENTALES

stEstimados amigos: 

Después de años de lucha contra el urbanismo descontrolado e insostenible que hemos sufrido en la Comunidad Valenciana, años en los que hemos cambiado impresiones con muchos de vosotros sobre la situación del urbanismo en general, hemos apreciado que ese urbanismo rampante, no era, ni es una exclusiva de nuestra Comunidad. Por el contrario es un mal estatal, abarca a todo el territorio. En cada autonomía se han aprobado leyes urbanísticas que propician esos desmanes, con sus secuelas de corrupción, encarecimiento de la vivienda,  degradación del medio ambiente y sellado del suelo por cemento y asfalto. El urbanismo ha sido interpretado como fuente de enriquecimiento, para unos políticos de moral acomodaticia con código de barras y unos especuladores de apetito insaciable, y se ha extendido por todo el territorio español como una epidemia medieval. 

Todo eso a pesar de algunos logros en esa lucha, como el haberla llevado al Parlamento y a la Comisión Europea, dando lugar a unos informes demoledores contra el urbanismo valenciano el llamado informe Fourtou y al urbanismo español en el más reciente y conocido informe Auken, así como la admisión a tramite de la denuncia presentada ante el Tribunal de Justicia Europea de Luxemburgo contra la Ley Urbanística Valenciana, cuya sentencia si nos es favorable podrá afectar a todas las demás leyes urbanísticas autonómicas en los puntos que tengan en común. 

Por todo esto y porque hemos constatado que en cualquier rincón de España se han organizado colectivos en defensa de sus derechos y propiedades, generalmente de carácter local, hemos procedido a fundar una Federación Española de asociaciones con el interés común de la defensa del territorio, por un urbanismo realmente sostenible. 

Este es el motivo de esta comunicación, nos complace anunciaros la creación de la Federación Española de Asociaciones en defensa de los Derechos Humanos y en contra de los Atropellos Urbanísticos y Medioambientales, que ha sido registrada en el Registro Nacional de Asociaciones con el número 50856.

Os invitamos a integraros en esta Federación que se plantea como objetivos de salida : 

·         Elevar el nivel de audiencia de nuestras reivindicaciones al Gobierno central;

·         Ampliar la caja de resonancia mediática a nivel nacional;

·         Plantear una acción conjunta de denuncias y quejas al Parlamento Europeo y sus instituciones;

·         Conseguir la modificación puntual de la Ley del Suelo estatal, especialmente en lo que se refiere a la figura inaceptable del Agente Urbanizador y a la valoración del suelo rustico/no urbanizable en los casos de expropiación;

·         Redacción de un libro blanco del Urbanismo. 

Hemos de aprovechar el tiempo que tomará la solución de la crisis económico-financiera que ha ralentizado la actividad urbanístico constructora para presionar y conseguir que las leyes recojan nuestras reivindicaciones. 

Por esta razón cuantos más seamos, mayor será nuestra fuerza y eficacia. 

Para facilitaros la toma de decisión os adjuntamos copia de los Estatutos de la Federación, así como de una pro forma de acta del acuerdo de adhesión que tendríais que remitir a modo de boletín de enganche si esa es vuestra decisión. 

Nuestra intención es convocar la primera asamblea general que establecen los estatutos en el mes de Octubre, que serviría como punto de partida de la actividad de la Federación.
