Querido Vice-presidente,  

Gracias por proporcionarme la información contenida en los dos documentos que me adjuntó en su carta del 31 de marzo. Los pondré a disposición del resto de miembros del Comité que se han tomado un profundo interés por los problemas relacionados con la aplicación del LRAU, y con la legislación sucesora como es la LUV.  Observo que los mismos también se han enviado al Sr. Cashman, primer vice-presidente.   

La preocupación expresada dentro del comité sin embargo sigue siendo muy fuerte porque no hemos recibido hasta ahora ninguna indicación sobre los medios previstos por las autoridades, o por los distintos niveles de la administración local, para proporcionar una compensación apropiada a la multitud de personas de nacionalidad española, e incluso ciudadanos europeos, que han sufrido graves injusticias derivadas de los abusos en la aplicación de  la LRAU.   

La Comisión de las Comunidades Europeas sigue esperando su respuesta relacionada con las infracciones cometidas del artículo 226, y les animamos a ustedes para que sean los más vigorosos y justos defensores de los intereses de la gente que en muchos casos ha perdido su propiedad  y  visto sus esperanzas de retiro destruidas por estos procesos.   

El Comité continúa recibiendo peticiones de los ciudadanos afectados, la más reciente  relacionada con el plan de desarrollo urbano de Parcent que debemos investigar. Nosotros les sugerimos que remitan estas peticiones también al gobierno valenciano, pero debido a las reglas que estamos obligados a seguir sobre protección de datos, no podemos remitirles a ustedes las quejas recibidas sin la previa autorización de los demandantes.  

Espero sin embargo que usted dé instrucciones para que se revisen los planes sustancialmente denunciados, como son los de Benissa,  Tibí, Parcent, y muchos más, tal como llamamos a hacer en el debate parlamentario de Estrasburgo realizado el pasado mes de diciembre. Porque, como nos indica la mayoría de los nuevos casos, las autoridades locales siguen conculcando los derechos de los ciudadanos a disfrutar de sus legítimas propiedades y también fallan en responder a las peticiones individuales de revisión de los planes. 

El hecho de que 34 nuevos planes fueron aprobados por las autoridades locales en el último minuto y sin la consideración apropiada, con el único objetivo del sortear el plazo fijado de terminación de la LRAU, demuestra la cuestionable motivación esgrimida. 

La voluntad del Comité, como he dicho, sigue siendo revisar la situación creada a estas personas, lo que no excluye la posibilidad de organizar posteriores debates sobre el tema en el futuro cercano, con la cooperación de las otras instituciones de la Unión Europea.

Dear Vice-President, 

Thank you for providing me with the information contained in the two substantial documents which you enclosed with your letter of March 31st. I shall make them available to other  members of the Committee who have taken a deep interest in the problems related to the application of the LRAU, and its successor legislation the LUV. I note they have been sent also to Mr Cashman, First Vice-Chairman. 

The concern expressed within the Committee nevertheless remains very strong as we have as yet received no indications whatsoever about the means envisaged by your authorities, or  by various municipal authorities, to provide a proper redress for the many individuals of Spanish nationality, or indeed for other European citizens, who have suffered gross injustice as a result of the abuses which have resulted from the LRAU. 

The European Commission is continuing to assess your response related to the Article 226 infringement proceedings and we are encouraging them to be most vigorous and fair,  and bear in mind the interests of the people who have in many cases lost their property and seen their  future plans and retirement hopes destroyed in the process. 

The Committee continues to receive appeals from citizens affected, the most recent being related to the urban development plan for Parcent which we shall be investigating. We do, incidentally, advise those concerned to make their appeals also to the Valencian government but because of the rules we are obliged to follow on data protection we cannot forward to you the complaints received without prior authorisation by all concerned. 

I hope nevertheless that you will give instructions to review substantially contested plans such as those for Benissa, Tibí, Parcent, and many more, as we called for in the parliamentary debate in Strasbourg last December. As the most recent cases indicate to us, local authorities continue  to abuse the rights of citizens to their legitimately acquired properties and they also fail to respond to individual requests to review the plans. The fact that 34 new plans were rushed through by local authorities at the last minute without proper consideration, and with the sole objective of beating the deadline under the LRAU demonstrates the questionable motivation of those concerned. 

The Committee will, as I said, continue to keep the situation under review and it does not exclude the possibility of organising further debates on the subject in the near future, with the cooperation of the other institutions of the European Union.
